On May 1, 2007 the New Hampshire Real Estate Commission came out with a new form
explaining the "Customer" or "Client" relationship with the real estate professional.The "Agency and Non-Agency Disclosure" is a form that must be signed prior to any discussion
of real estate between the consumer and the real estate professional. The signing at first meeting
also acknowledges that the consumer has received the disclosure and that the real estate
professional has presented it as required by law. A copy is to be given to all signatories and a copy
kept on file by the real estate agency.
This disclosure is not a "contract", it is a disclosure providing the consumer with the type service they
can expect if they choose to enter into either of the categories.
